1. Introductory Provisions
This Complaints Procedure regulates the process for exercising rights arising from liability for defects in goods purchased from ELOK s.r.o. via the online store www.elok.cz. This Complaints Procedure has been drawn up in accordance with Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection.
2. Liability for Defects
The Seller is liable to the Buyer that upon receipt, the goods:
- are free of defects,
- correspond to the description, type, quantity, and quality,
- is fit for the purpose for which such goods are normally used.
For consumer goods, the liability period is 24 months from the receipt of the goods, unless stated otherwise.
3. Exceptions from Liability
The Seller is not liable for defects that:
- arose from unprofessional use,
- were caused by incorrect assembly or connection,
- arose from mechanical damage,
- arose as a result of electrostatic discharge (ESD) if protective procedures were not followed,
- arose from normal wear and tear.
For goods intended for professional use, corresponding professional knowledge on the part of the Buyer is assumed.
4. Filing a Complaint
The Buyer is obliged to file a complaint without undue delay after discovering the defect. A complaint can be filed:
- by email to: eshop@elok.cz
- by post to the address of the company's registered office
The Buyer is obliged to describe the claimed defect, provide proof of purchase, and deliver the claimed goods (unless agreed otherwise).
5. Settlement of Complaints
A consumer's complaint will be settled no later than 30 days from its filing, unless the parties agree otherwise. In the event of a justified complaint, the Buyer has the right to:
- repair of the goods,
- replacement of the goods,
- a reasonable discount on the price,
- withdrawal from the contract (in the event of a material defect).
6. Complaints by Entrepreneurs
For Buyers who are entrepreneurs, liability for defects is governed by the relevant provisions of the Civil Code and commercial customs.
7. Returning Goods
You can return the product within 14 days of purchase; just fill out the online form and ship the goods or deliver them in person to the address: Elok s.r.o., Železničářská 1, 746 01, Opava, Czech Republic.
8. Final Provisions
This Complaints Procedure is valid and effective as of April 13, 2026.
